In short

  • Vivid Remedy publishes educational research summaries. It is not medical advice.
  • Reading this site does not create a doctor–patient or professional relationship.
  • Always consult a qualified clinician before acting on anything you read here — especially if you have a condition, take medication, or are pregnant.
  • We may earn revenue from advertising and affiliate links. This never determines our editorial conclusions.
  • You use this site at your own risk, and our liability is limited to the maximum extent the law allows.

The full terms below are legally operative. The summary above is provided for comprehensibility and does not limit or vary them.

1. Definitions and Construction

In this instrument: “Publisher” means the operator of vividremedy.com, together with its owners, officers, contributors, agents, licensors and successors in title; “Content” means all text, data, compilations, citations, graphics, metadata and other material made available on or through the Site, in any format and by any delivery method; “User” means any natural or legal person accessing the Site by any means; “Site” means the domain vividremedy.com and all subdomains, endpoints, feeds and syndicated instances thereof. Headings are for convenience only and shall not affect construction. The singular includes the plural and vice versa. “Including” and “such as” are to be construed without limitation. No rule of contra proferentem shall operate to construe any provision against the Publisher by reason of authorship.

2. Nature of the Content; Absence of Professional Relationship

The Content constitutes general informational and educational material comprising secondary compilation, summarisation and exposition of publicly available scientific and institutional literature. It is not, and shall not under any circumstance be construed as, medical advice, clinical guidance, diagnosis, prognosis, prescription, therapeutic recommendation, nutritional prescription, psychological advice, or the practice of medicine, dietetics, pharmacy, psychotherapy or any other regulated profession in any jurisdiction.

No physician–patient, practitioner–client, therapeutic, fiduciary, advisory, custodial or confidential relationship of any character is created, implied, or capable of arising by reason of a User’s access to, receipt of, reliance upon, or correspondence concerning the Content. Transmission of any communication to the Publisher, whether by electronic mail, contact form, subscription mechanism or otherwise, does not establish any such relationship and confers no duty of care beyond that mandatorily imposed by applicable law.

3. Primacy of Qualified Clinical Judgment

The User is directed to seek and rely upon the independent judgment of a licensed healthcare professional qualified in the relevant jurisdiction prior to acting or declining to act upon any matter addressed in the Content. The User shall not disregard, delay in seeking, or discontinue professional medical advice, diagnosis or treatment in consequence of any material published herein. Where the Content is inconsistent with guidance issued by the User’s treating clinician, the guidance of the treating clinician prevails absolutely.

Particular caution is directed to, without limitation: pregnancy and lactation; paediatric and geriatric populations; concurrent pharmacotherapy and the potential for pharmacokinetic or pharmacodynamic interaction; hepatic, renal, cardiac or endocrine impairment; immunosuppression; perioperative periods; diagnosed or suspected eating disorders; and any acute or chronic condition under active clinical management.

4. No Warranty; Provision “As Is”

The Content is furnished on an “as is” and “as available” basis. To the fullest extent permitted by applicable law, the Publisher disclaims all representations, warranties, conditions, undertakings and terms, whether express, implied, statutory or arising from course of dealing or usage of trade, including without limitation any implied warranty of merchantability, satisfactory quality, fitness for a particular purpose, accuracy, currency, completeness, non-infringement, uninterrupted availability, or freedom from error or malicious code.

Scientific literature is provisional, contested and subject to revision, retraction and supersession. The Publisher makes no representation that the Content reflects the current state of scientific consensus at the time of the User’s access, nor that any cited source remains extant, accurate, unretracted or correctly characterised. Publication or revision dates indicate editorial activity only and constitute no warranty of continuing accuracy.

5. Assumption of Risk

The User acknowledges that any dietary, nutritional, herbal, supplemental, fasting, exercise or lifestyle modification carries inherent and potentially material risk, including risk of adverse physiological reaction, allergic response, drug interaction, exacerbation of existing pathology, injury and, in rare circumstances, death. The User voluntarily, knowingly and expressly assumes all such risk arising from any decision taken in whole or in part by reference to the Content, and accepts sole and exclusive responsibility for evaluating the applicability of any material to the User’s own circumstances.

6. Limitation and Exclusion of Liability

To the maximum extent permitted by applicable law, the Publisher shall bear no liability whatsoever, whether in contract, tort (including negligence), breach of statutory duty, restitution or otherwise, for any loss or damage arising out of or in connection with the Content or the Site, including without limitation: direct, indirect, incidental, special, consequential, exemplary or punitive damages; personal injury; loss of profit, revenue, opportunity, data or goodwill; and loss arising from reliance upon, or inability to access, the Content, irrespective of whether the Publisher was advised of the possibility of such loss and irrespective of whether such loss was foreseeable.

Where liability cannot lawfully be excluded, it is limited to the greater of (a) the aggregate sum actually paid by the User to the Publisher in the twelve months preceding the event giving rise to the claim, or (b) the minimum sum permitted by the applicable mandatory provision. Nothing in this instrument purports to exclude or restrict liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability which may not lawfully be excluded or restricted; and the invalidity of any exclusion under a mandatory consumer-protection regime shall not affect the enforceability of the remainder.

7. Third-Party Content, Sources and Hyperlinks

The Site cites, references and may hyperlink to materials controlled by third parties. Such citation is made for attribution and verification purposes and constitutes neither endorsement nor adoption of the content, methodology, conclusions, commercial practices or privacy standards of any third party. The Publisher exercises no control over, and accepts no responsibility for, external resources, their availability, or any consequence of the User’s access thereto. The User’s engagement with third-party resources is governed exclusively by the terms of those parties.

8. Advertising, Affiliate and Commercial Disclosure

The Publisher may derive revenue from programmatic and direct advertising, affiliate arrangements, sponsored placements and similar commercial mechanisms, and may receive compensation where a User engages with such placements or effects a transaction with a third party. Such arrangements are maintained separately from editorial determination, and no advertiser, affiliate or commercial counterparty exercises approval, review or veto over editorial conclusions. Advertising served through automated networks is selected by those networks and does not signify Publisher endorsement of the advertised goods or services. This paragraph is made in satisfaction of applicable disclosure obligations, including 16 C.F.R. Part 255 and analogous provisions in other jurisdictions.

9. Regulatory Status of Statements

Statements appearing in the Content have not been evaluated by the United States Food and Drug Administration, the European Food Safety Authority, the European Medicines Agency, or any equivalent competent authority in any jurisdiction. No material published on the Site is intended to diagnose, treat, cure, mitigate or prevent any disease or condition. Regulatory classification of foods, botanicals and supplements varies materially between jurisdictions, and the User is responsible for ascertaining the status applicable to the User’s own jurisdiction.

10. Indemnity

The User shall indemnify, defend and hold harmless the Publisher against all claims, demands, proceedings, liabilities, damages, costs and expenses (including reasonable legal fees on a full indemnity basis) arising from or connected with the User’s misuse of the Content, the User’s breach of these terms, or any assertion by a third party arising from action taken by the User in reliance upon the Content.

11. Amendment, Severability and Governing Terms

The Publisher reserves the unilateral right to amend, supplement or withdraw this instrument at any time, such amendment taking effect upon publication; continued use of the Site following publication constitutes acceptance. If any provision is held invalid, unlawful or unenforceable by a court or competent authority, that provision shall be severed or read down to the minimum extent necessary, and the remaining provisions shall continue in full force. No failure or delay in exercising any right constitutes a waiver thereof. This instrument is to be read together with the Site’s Terms of Use and Privacy Policy; in the event of irreconcilable conflict concerning liability for informational content, this instrument prevails.

Nothing herein derogates from any non-excludable statutory right available to the User as a consumer under the mandatory law of the User’s habitual residence, including the User’s right to bring proceedings before the courts of that residence where such right is conferred by mandatory provision.
